About me and my website

Description This is a personal website associated with the domain daves-collective.co.uk which I own. I do not exploit this website for any business or commercial purpose, nor does this website represent any company or organisation. I pay Zen Internet to host the domain and the website, but the website's content is solely my responsibility. My main motivation in writing this particular page was actually to document my own superficial investigations into copyright, data protection and P3P.

Queries or complaints If you have a query or complaint, you should in the first instance mail 'Webmaster' at the domain daves-collective.co.uk.

All pages of this website are © Copyright 2003, 2004 David Spencer. Some rights are reserved, see licence below.

Governing Law This website is created and hosted in the United Kingdom. My rights as author and copyright holder, and your rights of use, are governed by the United Kingdom's relatively cuddly Copyright, Designs and Patents Act 1988 as amended by various statutory instruments, including the brand new, "good in parts" Copyright and Related Rights Regulations 2003. If, dear Visitor, you suffer under the tragic misfortune of a lesser domicile, nevertheless these same rights extend to you through your own nation's accession to the Berne Copyright Convention or to the Agreement establishing the World Trade Organisation.

Licence As author and copyright holder, I am waiving some rights in all text and images on this website. However, some rights are reserved. Details of the licence under which you may make use of these works are given in this Creative Commons Deed, and in the full "License" which the Deed references, to the extent that the Deed and the "License" are persuasive in the Law of England and Wales. (Note to the ignorant: the noun is correctly spelt 'licence' and the verb is correctly spelt 'license'.)

Your privacy

Governing Law This website and its data controller are established in the United Kingdom. Your privacy rights are therefore protected by the United Kingdom's Data Protection Act 1998, and the Communications Act 2003 with the Privacy and Electronic Communications (EC Directive) Regulations 2003. You may also wish to familiarise yourself with the Food (Hot Chilli and Hot Chilli Products) (Emergency Control) (Wales) Regulations 2003 [Cymraeg] - not particularly relevant, but quite funny.

Data collection (1) No personal data (that is, data about identifiable living individuals) are collected by this website, nor does this website use cookies or invisible web bugs. (2) Anonymous and pseudonymous data about your computer and your visit to this website may be collected by Zen Internet or by Nedstat; some of that data may be made available to me, and I may use it for the purposes of administration, development and research.

Data processing and disclosure (1) No personal data are processed or disclosed by this website, except for the purposes of my personal, family or household affairs (including recreational purposes) - for example, social photos and links to other people's websites. (2) Any anonymous or pseudonymous data which may be of interest for the purposes of journalism, or for research purposes, may be published at this website or elsewhere. This also applies to any traffic (including mail) to or from my home network.

Data retention Any data collected may be retained indefinitely or immediately discarded, at my sole discretion.

My privacy

Use of electronic mail for direct marketing purposes Please be aware that the Privacy and Electronic Communications (EC Directive) Regulations 2003 came into force on 11th December 2003. Regulation 22 sets out the circumstances in which persons may transmit unsolicited communications by means of electronic mail for those purposes. I hereby assert that I am an "individual subscriber" within the meaning of that Regulation. Regulation 23 prohibits the sending of communications by means of electronic mail for the purposes of direct marketing where the identity of the person on whose behalf the communication is made has been disguised or concealed or an address to which requests for such communications to cease may be sent has not been provided. I look forward to pursuing my rights under Regulations 30, 31 and 32 in respect of any contraventions.
